These Terms and Conditions (Terms) govern your access to and use of AusLanka Marketplace's website and marketplace services (Service). By accessing or using the Service, you agree to these Terms.

If you are using the Service on behalf of a business or other organisation, you represent that you are authorised to bind that entity to these Terms.

These Terms apply in addition to our Privacy Policy.

AusLanka Marketplace is a platform that helps buyers and sellers find each other. We do not own, buy, sell, or deliver listed items, and we are not a party to transactions between users.

Users are responsible for their listings, negotiations, payments, and delivery arrangements.

• You must be at least 18 years old or have permission from a parent or guardian to use the Service.
• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must promptly notify us of any unauthorised use of your account.

You agree that listings and content you publish must:

• be accurate, not misleading, and not deceptive;
• comply with applicable laws (including Australian Consumer Law);
• relate to items you have the right to sell or list;
• not infringe intellectual property, privacy, or other rights of any person;
• not contain unlawful, hateful, or prohibited content.

You are solely responsible for your listings and for your interactions with other users.

You must not list or request:

• illegal, stolen, or counterfeit goods;
• unsafe products, regulated items, or goods that require licences you do not have;
• items that breach another person's rights or privacy.

We may remove listings or restrict accounts that violate these rules or applicable law.

Transactions are arranged directly between buyers and sellers. We do not process payments or provide escrow services.

We recommend meeting in safe, public locations, inspecting items before payment, and using secure payment methods. You should never share sensitive financial information.

The Service may be offered free of charge or with optional paid features. If fees apply, we will disclose them before you confirm any purchase.

We (and our licensors) own the Service, including its software, design, and branding, excluding user content.

You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, and distribute your listings as necessary to operate and promote the Service.

We may (but are not obliged to) monitor, remove, or restrict access to content that we reasonably believe violates these Terms, is unlawful, or could harm users or the Service.

The Service may include links to third-party websites or services. We are not responsible for third-party content, products, or services. Your use of third-party services is subject to their terms and policies.

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

We do not guarantee the quality, safety, legality, or availability of items listed, or outcomes from using the Service.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or other applicable law that cannot be excluded, restricted, or modified.

To the extent permitted by law, our liability is limited (at our option) to re-supplying the Service or paying the cost of having the Service supplied again.

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or opportunities.

You agree to indemnify and hold us harmless from claims, damages, liabilities, and expenses (including legal fees on a solicitor-client basis) arising out of or related to your use of the Service, your listings, or any breach of these Terms.

We may suspend or terminate your access to the Service if we reasonably believe you have breached these Terms, or if required for security, legal, or operational reasons.

You may stop using the Service at any time. Some provisions of these Terms will survive termination (including intellectual property, disclaimers, limitations of liability, and indemnities).

We may update the Service and these Terms from time to time. Changes will be posted on this page with an updated revision date. If changes are material, we may provide additional notice where reasonable.

These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia and the state or territory in which we are established.
